There are certain milestones and periods in our lives when notarized documents may be required. New relationships, partnerships, children, and even divorce, can require signatures to be validated and certified. A mobile notary public in Southeastern Massachusetts can be a valuable service, especially when it is challenging to leave work or spare extra time away from home.
Some of the Family Notary Services that we provide include:
Estate Plans
While not required by Massachusetts law, notarization can simplify the probate process when handling estate plans. Signed by the Testator and two disinterested witnesses, a will is considered to be self-proving. This prevents many delays that can be common during the execution of an estate.
Wills, Trusts, and Codicils
Similar to the guidelines for estate planning, documents such as wills, trusts, and codicils do not require notarization in Massachusetts. However, taking the time to hire a notary public will speed up the process because the court can accept the documents without having to contact the witnesses to confirm their signatures.
Guardianships
In Massachusetts, a parent may consent to guardianship if they sign the documentation in front of a notary public. The court will only appoint a Massachusetts Guardianship if there is strong evidence of unfitness on the part of the parents to care for the child.
Adoption Papers
Throughout the process of adoption under Massachusetts law, there are many documents that must be filed, signed, and, in some cases, require notarization. The Affidavit of Petitioner for Adoption must be completed by the person or people who are seeking to adopt, and the signatures must be notarized by a notary public.
Divorce and Annulment Papers
There are several different options when it comes to filing for divorce or annulment in Massachusetts. If you want to get a no-fault divorce, both spouses must sign the separation agreement, sign it, and have it notarized. This type of filing is also known as an uncontested divorce. We can offer same-day notary services, as well as schedule an appointment to meet you at your home, place of work, or in a public location.
Financial Support Documents
While not required for short-form financial statements in Massachusetts, those who file the long-form as part of a divorce involving alimony, child support, or property division must get their signatures notarized by a licensed notary public.
Parental Rights Affidavit
The legal documents required for parental rights, including giving up parental rights, temporary removal of parental rights, and a Caregiver Affidavit, which allows the caregiver to make medical and educational decisions on behalf of the child, can be quite complex. These forms should be signed in front of two disinterested witnesses and a notary public.
Domestic Partnership
A Declaration of Domestic Partnership is a statement that is signed under penalty of perjury that should be signed in front of two disinterested witnesses and a notary public in Massachusetts. When this document is signed, the two people swear that they meet the definition of domestic partnership and all related requirements.
School Documents
Certain forms may be required to obtain a Release of School records from a school, including K-12 education, colleges, universities, and trade schools. Notarized or certified documents, known as Apostille Certifications, may also be required from a foreign school for individuals, schools, colleges, universities, and businesses in Massachusetts.
Minor Child Consent to Travel
In situations where a custodial parent wishes to allow the non-custodial parent to travel with a minor child or children, a Minor Consent Form is required. It is essential to have the document filled out correctly and to have it notarized in front of credible, disinterested witnesses. In most cases, a general form will be all that is needed; however, some countries have specific forms that must be completed.
Prenuptial Agreements
In Massachusetts, a prenuptial agreement can only be enforced if it is considered to be “fair and reasonable” at the time that it was signed before the marriage and again when it is requested to be enforced. All prenuptial agreements must be in writing and notarized, just like any other legal or financial document.
